Lawyers for Colorado movie shooting suspect James Holmes say he intends to plead not guilty by reason of insanity, according to court documents.

Holmes is charged with killing 12 people and wounding 70 when he opened fire on a theater audience watching a Batman movie last July.

His next court appearance is set for May 13. A judge originally entered a not guilty plea for Holmes when Holmes declined to speak in court early in the case.

A jury could still find Holmes guilty, which could bring the death penalty.
