An Egyptian appeals court on Monday ordered the release of former president Hosni Mubarak in a case involving charges of orchestrating the deaths of protesters, but he will remained jailed on corruption allegations.
Mubarak's lawyer sought his release on grounds that the ex-president, 84, has already spent two years in prison without conviction, exceeding the maximum term for temporary detention.
A court session to retry Mubarak ended abruptly Saturday when the judge handed the case back to an appeals court. The former president was sentenced to life in prison last year, a verdict that was later overturned by another court.
Mubarak's conviction centered on failing to protect protesters against violence during an uprising which overthrew him.
However, he also faces new separate corruption charges that will keep him jailed.
Mubarak is being held at a military hospital in a Cairo suburb. His lawyers say he is suffering from a variety of physical ailments.
